    Who can represent a client in a bankruptcy hearing?
    If a lawyer is licensed in Massachusetts, or Maine, which are both in the 1st circuit, and the lawyer had been admitted to the 1st Cirucit Federal Bar, can the lawyer represent a client in a bankruptcy hearing, such as at a creditors meeting and filing chapter 7 forms in New Hampshire. Does the attorney need to be licensed by the NH Bar first?

    I need help, Please.

    I lived in PA my whole life, own a home there. I lost my job 1.5 years ago, and I had to file bankruptcy in april of 2007. For the past 8 months I have been staying with a friend and working in Missouri. But my home is in PA, but been using my friends address for local employment.

    My question is:

    Do I file my federal and state taxes for Pennsylvania like I always have? If I do that, and on my PA forms, put down taxes that were paid to MO, or do I have to file MO only, and if I do that, PA will be looking for me for taxes? Or if I do the PA income tax, will MO be after me for a tax return?

    Also, does my bankruptcy and chapter 13 payment plan affect my tax return at all?

    I am in need of help. I always do my taxes myself cause I cannot afford to pay an accountant right now.

    Please help.

    Does anyone know why EdFund says on loan default form that you can dissolve it in bankruptcy?
    Ok, so theirs this form they send in the mail to people who are behind on loan payments, that says check one of the following boxes, one of them is , ‘This loan was discharged in bankruptcy’ , but is EDFUND a federal loan, that cannot be dissolved in Bankruptcy? The student is thinking of declaring bankruptcy but was under the impression that this could not be dissolved in Bankruptcy? Does anyone have a clue? Do federal / non federal student loans dissolve/ or do not dissolve, in bankruptcy? Or what is the deal?

    bankruptcy is a federal thing so why do forms say particular states have different laws?
    are their different laws in different states regarding chapter 7 bankrupcy? i was told no, because it is federal, but why do all online sites/forms declare that each state is different and to specify where you live.

    i’m asking, because i can live in one of 4 states, as i’m currently not working and can choose a family member in CA, FL, DE, WA or TX to live with…..

    What exactly do I need to study in order to become a bankruptcy petition preparer in Sacramento?
    Note: I’ve already been told REPEATEDLY by my supervising attorney that I need to study the Federal Rules of Bankuptcy, Section 110 of the United States Bankruptcy Code, and a document preparer’s handbook.

    1) I need specific code sections because the Federal Rules of Bankruptcy is well over a thousand pages worth of text, over half of which is not relevant to the specific work I would be doing.

    2) I already know the two forms I would need to have signed by myself and prospective clients/debtors and I am keenly aware that I do NOT have the right to delegate any type of legal advice, so you don’t need to tell me this either.

    3) If a bankruptcy petition preparer guidebook exists feel free to shoot me a link or tell me where I can buy it, otherwise I shall remain certain that no such thing exists and that my supervising attorney really doesn’t know what the hell he’s talking about.
    Thank you for your quick response. I am a certified paralegal in who works as a glorified file clerk for my supervising attorney in Downtown Sacramento. My supervising attorney is a solo general practitioner. I’ve tried to get some help from him, but he’s really busy and insists upon me finding some type of document preparers handbook as well as thoroughly studying the Federal Rules of Bankruptcy. I’ve spent days researching online and can not find such a handbook and the Federal Rules of Bankruptcy includes a great deal of information, a lot of which is not pertinent to a bk petition preparers line of work.

    Do you know if I could buy those books online? If not I suppose I could go to Folsom Lake College or American River College during the upcoming week to find them. I just hope that I won’t need to take yet another legal course because I already spent a year at MTI attaining my Paralegal Studies A.A. and THREE years attaining my B.A. in History prior to that.

    It is federal and the federal laws trump state laws. But in some states a creditor can come after a homeowner for any delinquency on their mortgage. In other states, the homeowner is protected from creditors if the mortgage was used to purchase the property.
    Each state has Homestead Laws that protect equity from creditors other than mortgage lenders. In Arizona, the first $100,000 from the sale of the home is exempt from creditors.
    All those things have an effect..

    EDFUND is a guarantee agency for student loans. It is based on California but can operate nationally.

    Federal student loans may not be discharged in bankruptcy. Period. Years ago, it was possible, but the laws changed a long time ago on that. Loans like that would likely no longer be around and would not have existed at all since EDFUND was founded.

    There are other loans (private student loans) that are not federally guaranteed and those can be bankrupted.

    “Student loans” that are not government-backed can be bankrupted. Government-backed loan can be bankrupted. So it depends on what sort of loan is being discussed.

    If you use a program like TurboTax it will take you thru the process and asks you the relevant questions. $40 is a good investment in knowing you did your best with this gruesome task. I highly recommend it because tax code is complex and none of us is expert. Their publications are written by bureaucratic lawyers and not in real English.

    you pay income on taxes depending on where it was earned, in this case MO. the only taxes you would pay in PA (not to the IRS) are property taxes on your home.

    can’t address bankruptcy but I think the TurboTax program does

    As long as the attorney has been admitted to practice in the federal courts of some state, he may represent a bankruptcy client in some other federal district or state.
