Filling out bankruptcy forms can be one of the most difficult parts about filing for bankruptcy, although these forms are a necessary evil to complete the legal process. Unfortunately these legalities can add major emotional stress to an already difficult situation. Especially if you have decided to go about filing on your own, without the help of a lawyer or financial service company, you may find yourself overwhelmed with trying to understand which bankruptcy forms are right for which chapter.
If you are an individual who is filing for bankruptcy, most likely you will be filling out bankruptcy forms specifically dealing with either Chapter 7 or Chapter 13. Even as a business you may be filing for Chapter 7 bankruptcy or Chapter 13, although you may be filing for Chapter 11 as well. In any case, there are separate forms that need to be filled out with each particular chapter stating the intention to file bankruptcy under that chapter.
The individual or business may also have other special bankruptcy forms that go along with a particular chapter. For instance, Chapter 13 and Chapter 11 are reorganization chapters and will require a form that discusses how and when creditors will gather to meet and discuss the finances of the individual or business for repayment plans. If the individual is filing for a complete liquidation, Chapter 7, forms for possible exemption of assets will need to be filled out if the debtor plans to keep any of their personal belongings.
In all cases, the debtor will be required to file bankruptcy forms regarding a statement of petition, a list of creditors, personal income, personal property, and Declaration of penalty under perjury. These forms will simple let the courts know of the individual or business’ plan to file, the assets the debtor has available, the current available income, and the debtor’s knowledge that lying about finances will have legal consequences.
With the new age of technology, all bankruptcy forms are available through the United States court system at http://www.uscourts.gov/bkforms/bankruptcy_forms.html. Of course the availability of the forms does not necessarily mean that all individuals or businesses will clearly understand which forms apply to them. If you are confused about which forms to fill out, don’t be afraid to ask the court system for help.
Unfortunately the court system may be overwhelmed with other cases they feel are more important making it difficult to find answers to bankruptcy form questions. In this case, you can always consult with a legal aide, a bankruptcy attorney or even a financial service organization that can help you understand the paperwork better.
Even if you don’t plan on hiring an attorney to handle the case for you, it may be worth the time and energy to consult them regarding the paperwork that goes along with the process. You may also want to consider a bankruptcy service organizations online, which can help answer questions and guide debtors through the process.
Keep in mind that each state court system has secretaries available who can type up the forms for you, although there will be an additional charge for this service. Most law firm or legal aide organizations have similar services that may be beneficial in helping debtors get through the process of filing bankruptcy forms.

what forms do i need to file bankruptcy?

How to I file a claim for reimbursement against a company that filed bankruptcy?
Today I called about my gift card for Bennigan’s and I received the following message.
“S&A Restaurant Corp. and certain affiliates have filed for bankruptcy under Chapter 7 of the bankruptcy code. The companies that filed bankruptcy cases are popularly known as Steak & Ale, Bennigan’s and Tavern restaurants. However, not all stores using these trade names have filed bankruptcy. For example, stores operated by franchisees are not named as debtors in these filings.
“It is our understanding the Michelle Chow will be appointed as Chapter 7 trustee for the entities that have filed. These are filed as liquidation cases. Future decisions regarding the affairs of the debtor companies will be determined and administered by the trustee.
“If you wish to file a claim, the form Proof of Claim can be found online at: http://www.uscourts.gov/rules/BK_Forms_1207/B_010_1207f.pdf.
“The filing does not include Ponderosa and Bonanza which operate under Metromedia Steakhouses Company, L.P.”
My question is…
How do I file a claim? (There are many terms and questions on the form that I am not familiar with and I would love to see an example of a completed form.)
Married but live apart and filing for Chapter 7 Bankruptcy?
I live in Oklahoma and am married but have been living apart from my husband for several years with my daughter and have been filing head of household on my tax returns. I would like to know how I would file chapter 7 bankruptcy? Does my husband have to be apart of the legal process? I have only one asset which is my car. My husband is the “owner” and I am listed as the co-borrower but I am the one who actually owns the car and makes the payments. I have been behind on my payments but have recently caught up and i would like to reaffirm the car loan? Here is the bankruptcy law that pertains to this:
Married, not filing jointly, with declaration of separate households. By checking this box, debtor declares under penalty
of perjury: “My spouse and I are legally separated under applicable non-bankruptcy law or my spouse and I are living
apart other than for the purpose of evading the requirements of § 707(b)(2)(A) of the Bankruptcy Code.”

Haven’t received 1099-C (Cancellation of Debt/Bankruptcy) tax form from gov’t yet..?
..is there a way I can get the form online? Was it supposed to be mailed to me when the debt was discharged?
I read the following: Form 1099-C. If a federal government agency, financial institution, or credit union cancels or forgives a debt you owe of $600 or more, you will receive a Form 1099-C, Cancellation of Debt. The amount of the canceled debt is shown in box 2.
I know the debt was offically discharged in mid 2009.
I suggest that you go to the court and tell them you are filing Chapter 7, and ask for the necessary forms. If they do not have blank copies, you can ask for a list of the forms that are needed. That way you are sure that you have corect, current information. This will save you a lot of wasted time and effort. They can also tell you filing fees, etc. ( I am formerly the Recorder of Deeds at the Court House.)
The laws have changed on how you get and who can file the forms. Used to, you could get them, fill them out yourself and file yourself. Now you have to hire someone legally certified to do it for you. This does not have to be an attorney btw… when they changed the law they created certification for this.
Making it cost more money to file bankruptcy was part of trying to deter ppl from filing.

Just a suggestion-you might be better off using the gift card at a franchisee owned Bennigan’s (they are still open and operating).
If you file a claim about your gift card there still is a strong chance you will not receive and money for it. Under Chapter 7 the debtors will get paid first (doesn’t include gift cards) and there may not be any money left after that. When a company files Chapter 7 usually they are in very serious debt.
I have read and heard that there are employees who will not see their last paycheck because there isn’t money to pay them. Very sad.
